Under California Vehicle Code Section 13352, the DMV must suspend or revoke your driving privilege upon receiving a court abstract of a DUI conviction. For a first-time offense, this usually means a six-month suspension. For second or third offenses, you face two or three years of being grounded.

Navigating the Reinstatement Process in 2026

Mandatory Requirements for Driver’s License Reinstatement

  • Complete Your Suspension Period: You must serve the term dictated by your specific conviction or administrative action
  • Enroll in and Complete a DUI Program: Depending on your blood alcohol concentration (BAC) and history, this could be a 3-month (AB 541), 9-month (AB 1353), or 18-month (SB 38) program
  • File an SR-22 Insurance Certificate: This is a Proof of Financial Responsibility form that your insurance company must file directly with the DMV
  • Pay Reissue Fees: The DMV currently charges a $125 reissue fee for DUI-related reinstatements

The Ignition Interlock Device (IID) Option

California law recently extended the Statewide IID Pilot Program through January 1, 2033, under Assembly Bill 366. This program is a game-changer for many of our clients. By installing a certified IID, you can drive anywhere, at any time, as long as you provide a clean breath sample. We know the science behind these machines. Post-Conviction Relief: Expungement under PC 1203.4

A conviction does not have to haunt your background check forever. In California, you can petition for a dismissal under Penal Code Section 1203.4, commonly known as an expungement.

If the court grants this petition, your guilty plea is withdrawn, a not guilty plea is entered, and the case is dismissed. While this does not erase the record from the DMV or law enforcement databases, it allows you to truthfully state to most private employers that you have not been convicted of a crime. This is a vital step for professional growth in San Bernardino County and beyond.

Be aware that starting in 2026, Assembly Bill 1087 allows San Bernardino judges to extend probation for up to five years for cases involving high BAC levels or minor children. This extension means you may have to wait longer before you are eligible to file for an expungement.
